COMES NOW the Respondent, CELESTE J. BRACE, by and through her attorney, Joseph Mendoza, and as and for her petition for modification of custody, parenting time, and support avers, alleges, and states as follows:1. The parties have one (1) child, namely, JACOB ERROLL ORTIZ, born March 29 2010. The minor child has resided in Arizona since his birth.
2. On August 2, 2013, the Cochise County Superior Court entered an Amended Judgment and order for Paternity, Parenting Time and Child Support which granted sole legal decision making authority of the minor child to the Petitioner and a majority of parenting time as set forth in the incorporated parenting plan.
3. The Respondent was to have parenting time at the Petitioner’s discretion, going from supervised to unsupervised. This was successfully done with the mother having unsupervised parenting time by the middle of 2014.
4. Additionally, child support was to be paid in the amount of $180.00.
5. Since entry of the prior orders regarding custody, parenting time, and support, there has been a change of circumstances warranting an additional modification of custody, parenting time, and support as follows:
CUSTODY, PARENTING TIME AND CHILD SUPPORT
a. The father, herein Petitioner, has voluntarily given the child back to the Respondent and signed a letter to that effect. The Respondent has taken care of the child since
December of 2014.
b. The Petitioner is homeless and using drugs and continuing the current legal decision making order and parenting time order would not be in the child’s best interest pursuant to AR.S.sec.25-403.04. The Petitioner has not had any meaningful communication with the child since he turned the child over to the mother four months ago.
6. The Petitioner is not financially supporting the child, this is being dome completely by the Respondent.
7. This Court has jurisdiction to decide child support matters, pursuant to the provisions of Rule 91, Arizona Rules of Family Law Procedure and A.R.S. § 25-320(A), which states in part, “the court may order either of both parents owing a duty of support to a child ... to pay an amount reasonable and necessary for support of the child.”
8. The Respondent requests that child support be modified according to the guidelines as it is necessary for the support of the child.
9. This Court has jurisdiction to decide legal decision making authority and parenting time modification, pursuant to the provisions of Rule 91, Arizona Rules of Family Law Procedure and A.R.S. § 25-411 (J), which states in part, “the court may modify an order granting  or denying parenting time rights whenever modification would serve the best interest of the child, ....”
10. The present order was signed on August 2, 2013, and is a sole legal decision making authority order in favor of the Petitioner. The Petitioner is no longer taking care of the child, is not making any decisions for the child, is not communicating with the child and he is homeless and using illicit drugs. The Respondent should be awarded sole legal decision making so the needs of the child can be met on a consistent and day to day basis. The Petitioner’s parenting time rights should be restricted until he can show that he is able to care for the child without seriously endangering the child’s physical and emotional well-being.
WHEREFORE, Petitioner prays that this Court enter orders:
A. Setting a date, time, and place certain for a hearing;
B. Modifying the Legal Decision Authority and Parenting Order as requested hereinabove.
C. Finding that Petitioner is responsible for child Support pursuant to the child support guidelines.
D. Awarding Respondent her attorney’s fees and costs.
E. Grant such other and further relief as the Court deems just and proper.

The City of Bisbee is looking for a volunteer to operate a video camera for all Mayor and Council Regular Sessions, Work Sessions and Special Sessions.  Regular Sessions are held every First (1st) and Third (3rd) Tuesday of every month beginning at 7:00PM.  Work Sessions and Special Sessions are held on an as needed basis and always begin after 5:00PM, usually before 6:00PM.  Meetings typically last around two (2) hours, but can be much longer or shorter.  Equipment and training will be provided by the City.  Any interested party is encouraged to submit a letter of interest to the City Clerk’s office by 5:00PM on August 17, 2015.  If there are any questions regarding this volunteer position please contact Ashlee Coronado, City Clerk, at 520-432-6012.
